Three Games for Doan's hit on Sexton
So it looks like Shane Doan is getting a three game suspension on the hit on Dan Sexton.

I for one actually think it's pretty excessive. It was definitely a dangerous play and an example of what the league is trying to crack down on, but I was thinking it was going to be more like one game - maybe two max.
As silly as some of you may think I sound, I do think the outcome needs to taken into consideration for suspensions. For example, Hjalmarsson's hit on Pomminville should definitely been given a larger suspension based on what happened to Pomminville. Plus extra because his name is so hard to spell.
The legal system takes into account what happened to the victim and so should the NHL. Breaking and Entering and Theft vs. Robbery; Murder vs. Attempted murder... People who think the action should only be taken into consideration aren't looking at the big picture. It's important that the players we all pay good money to see get to play and not have to sit on the IR.
Anyway, getting off my high horse, I really only wanted to state that Doan was getting three games for the hit. A bit excessive in my mind since nothing really came of the hit. But I suppose the NHL was using this as an example.

Maybe it was excessive because Doan fucked up Cam Fowler earlier in the game and Cam never returned?
Although Fowler was taken out, that should not have been in consideration. Fowler’s injury in my mind was more unfortunate than anything. Fowler definitely tried to do a bit too much and he was already off balance and skating quite fast. I don’t really think Doan really hit him that much. It was the fact that a small bump knocked down an already off balance player who unfortunately went into the boards face first. I think that Fowler would have crashed into the boards with or without that hit – maybe not face first, but would have crashed into the boards.
I for one didn’t think much of the hit on Fowler except that it sucked to lose him and was hoping that he was ok.
I would hope the league didn’t take earlier actions into account for the blindside hit.
Why, the legal system (and I harp on that because I’m a lawyer and thought it was funny that you brought it up) takes prior bad acts into account?
Colin Campbell certainly did when he let Doan slide for punching Vishnevski after the game was over, even though Campbell said his Instigator at the end of a game rule would be enforced black and white. Why shouldn’t Doan receive extra punishment because of his history, whether it’s a new rule he broke five years ago or a video they reviewed just before the hearing of what could easily have been called a 2 minute Boarding penalty even if it wasn’t a suspendable offense?

I’m not talking about prior bad acts. I’m talking about the outcome of the act. I’ve heard a lot of arguments in regards to punishing the action and not the result of that action. A lot of people didn’t think Hjalmarsson should have been suspended and only was because Pomminville got hurt. I do think it was a blindside hit. I don’t think Pomminville actually saw Hjalmarsson. He was turning his head, but I think he saw the other Chicago player who was skating by and not Hjalmarsson. Either way, the hit was dangerous and the fact that Pomminville was injured definitely should be in consideration for the punishment.
As far as my thoughts on priors, they also should be taken into account. If the smaller punishment didn’t stop you, then you get a bigger one next time. I don’t recall the whole Vishnevski incident so I can’t comment on that. As for the hit on Fowler though, I don’t believe Doan laid a dirty hit on him. That’s why I don’t think Fowler’s hit should have been in consideration for the suspension for the hit on Sexton.
If you didn’t see either incident as determinative, whatever. The point is, the league seems to have. Doan was not clean enough for them to make this a “no prior record” situation and wait to make an example of the next player. Whether they cared about the punch on Vishnevski or the fact that they had to review two borderline hits from a player in the same game, they clearly factored in who Doan was, just as they did when they chose not to suspend him for punching Vishnevski, even though they said they were going to set a bright line rule that year.
My key point was that it’s ludicrous to try to hold a workplace disciplinary system to the example of the American legal system, especially when that workplace reaches its rules through collective bargaining with a union. If players don’t want to be fined for every little thing, they won’t be. If players don’t want to have to recompensate an injured player for what can be an unintended injury on the ice (and what cannot be recovered by tort because both players consent to the battery that occurs within the context of a hockey game). The NHL is not going to fine Doan for a missed 2 Minute Boarding call on Fowler because it sets a precedent where they could fine guys for every penalty in the book. By contrast, the IRS will throw you in jail for not paying your taxes for a whole heap of social imperatives that don’t exist in hockey. You can’ t just compare them because they both seem to involve punishment to you.

I would assume so since we don’t have a 7th defenseman right now with Mikkelson being waived and no call-up occurring (granted they still have a day or two).

Yeah, hoping the same.
However, Fowler did go a little crazy once he scored that goal. It was like he started to feel invincible. He was trying to do everything and look what that got him – his first NHL broken nose.
